Key terms: sale, delivery & risk

Bouquet delivery

Orders & acceptance

Online orders are offers to purchase. We confirm acceptance by sending an order confirmation and dispatch notice. Estimated delivery windows are indicative.

Packaging and risk

Risk & title

Risk passes to the recipient when the bouquet is delivered to the delivery address. We take care with packaging to protect goods in transit.

Consumer rights & guarantees (New Zealand)

Below is a summary of important statutory rights under New Zealand law. This is not legal advice; it summarises the effect of the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 as relevant to perishable goods sold online.

Goods must be of acceptable quality and fit for purpose. For fresh flowers this includes being fit for normal domestic use on delivery. If not, consumers have remedies including repair, replacement or refund depending on circumstances.

We must not mislead consumers about products or delivery. Product images are indicative; we use like-for-like substitutions when inventory changes, retaining value and style.

For perishable goods like flowers, cooling-off rights are limited. If an order is cancelled before dispatch we will refund in full. After dispatch, CGA and Fair Trading Act remedies apply where goods are faulty or not as described.

Liability, limitation and disclaimers

To the maximum extent permitted by law, Choiceentry's liability for direct loss arising from product defects or delivery issues is limited to the purchase price of the goods. We are not liable for consequential or indirect losses, except where statute (including the CGA) prevents such exclusion.

Claims for damaged or missing items must be made within a reasonable time of delivery; please provide photos and order details to help with claims processing.
